In line with its policy of continued improvements to the high levels of service offered to clients, Corr Recruitment is currently offering detailed advice regarding compliance to the Agency Workers Regulation, which was laid before parliament in January 2010 and comes into force in the UK on October 1 this year.
The Agency Workers Directive (AWD) is designed to give agency workers the right to equal treatment after 12 calendar weeks in a given job.  Equal treatment only covers ‘basic working conditions”.  These conditions will cover items such as working time, overtime, breaks, rest periods, night work, holidays and pay. In many cases, the simplest approach will be to compare the position of the agency worker with that of permanent employees doing the same or broadly similar work. Companies that fail to comply with these new regulations face anti-avoidance clauses with fines up to £5000.
Corr’s presentation covers detailed information on the new regulation and discusses the seven solutions available to employers in order for them to comply. These include the ‘As if’ or ‘Harmonisation’ option, which basically means ensuring that the agency worker is provided with the same basic working conditions as a comparable employee (i.e. as if they had been recruited directly by the company.
